Terms and Conditions
Effective October 1, 2007
1. Payment Obligations: Full hosting payment is required in advance, before hosting service is established. Payment-due notices will be sent by electronic mail, unless otherwise requested by client. If payment is not received by the renewal date, your account will be suspended. Hosting will resume after full payment has been made plus any late or reinstatment fees if applicable. There is a $25 fee for bounced checks and a $10 processing fee for chargeback. Agape Creative requires a 50% deposit prior to production, then 50% upon completion. Websites we design will not be published live until 100% of all expenses are paid, to include fee's for additional client change requests, and hosting fees when applicable. A $3 handling fee will be added to any payment made by check or cash under the amount of $25.
2. Renewals: Your hosting account will be automatically renewed under the same time and fee structure unless you give written notice to Agape Creative, fifteen (15) days before the renewal date that you do not wish to renew such account.
3. Hosting Policies: Due to occasional maintenance issues related to computer hardware and software, Agape Creative can not guarantee 100% 24/7/365 service for websites we host.
4. Transfers: If you wish to transfer your website to another hosting provider Agape Creative, can, upon request, download your site onto a CD and mail it to you. The cost for this service $35. We will not upload your website via FTP or take responsibility for content, functionality, maintenance or related issues.
Agape Creative does not take responsibility for domain names that expire due to non payment by client. If a domain name expires due to non payment (whether the client registered it or Agape Creative has) the client may be subject to unspecified reinstatement fees.
1. Starter Special: Agape Creative is not responsible for content. This package type is a "self service" account, therefore client is solely responsible for website content, design, FTP uploads, backups, technical support of any kind, maintenance and related actions. Email is not supported. Space is limited to 5 MB. Added space and email services are available if client upgrades to a higher level package.
2. Basic Web Hosting: Email is not included.
3. Total Control: It is strongly advised to clients who use the Do It Yourself Client Editor (available for this account type) to subscribe to our daily backup program for an additional fee. Since all changes are stored online only, and not on our local computers, accidental mistakes to the website could occur during a client editing session, and Agape Creative would not be able to revert the website to a previous state unless there is a back up in place.
